1. ACCEPTANCE OF TERMS
By accessing or using the Haircare Tracker by Rooted mobile application ("the App") or any services provided by Rooted Haircare LLC ("the Company," "we," "us"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Rooted Haircare LLC.
2. ELIGIBILITY
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have the permission of a parent or guardian to use the App.
3. MEDICAL DISCLAIMER
ROOTED IS NOT A MEDICAL PROVIDER.
Information Purposes Only: The App and its associated Digital Content (as defined below) are provided for educational and informational purposes only. They do not constitute medical advice, diagnosis, or treatment.
No Doctor-Patient Relationship: Use of the App does not establish a doctor-patient or professional-client relationship. Always seek the advice of a qualified healthcare professional regarding any medical condition.
Assumption of Risk: You are solely responsible for your use of any information, routines, or products tracked or suggested within the App. We are not liable for any adverse reactions, injuries, or lack of results.
4. PURCHASE OF DIGITAL CONTENT
The App offers various non-tangible, irrevocable digital goods, including but not limited to downloadable guides, and in-app data presets (collectively, 'Digital Content')
License: Upon purchase, we grant you a limited, non-exclusive, non-transferable license to access the Digital Content for personal, non-commercial use.
5. REFUND POLICY
Finality of Sale: Due to the nature of Digital Content, all sales are final. Once access is granted or a download has commenced, the transaction is non-refundable.
Platform Terms: Payments are processed via the Google Play Store or Apple App Store. Their respective terms and refund windows also apply to your transaction.
6. INTELLECTUAL PROPERTY
All App content, including designs, text, graphics, and Digital Content, is the exclusive property of Rooted Haircare LLC. You may not copy, redistribute, resell, or create derivative works from our intellectual property without express written consent.
7. USER DATA & PHOTOS
You retain ownership of the photos and data you upload. By using the App, you grant Rooted LLC the permission to host and process this data solely to provide the services requested. Your data is handled according to our Privacy Policy.
8. LIMITATION OF LIABILITY
Rooted Haircare LLC and its members shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App or any Digital Content. Our total liability is limited to the amount paid by you for the specific product or service giving rise to the claim.
10. AMENDMENTS
We reserve the right to update these Terms at any time to reflect changes in our services, policy, or legal requirements. Continued use of the App after updates constitutes your acceptance of the new Terms.
